Conditions of Use

Important information:
Payment by cash on delivery or direct debit is not possible exterior of Germany!

1. General Terms
1.1. The following terms apply to deliveries of goods and services effectuated by us for our customers.
1.2. Offers are open. Orders are only obliging to us, if they have been confirmed by us or the goods are sent. Other oral agreements apply only, if they have been confirmed by us in writing.
1.3. The terms are considered accepted and obliging to the customer unless other agreements in writing have been arranged or no immediate objection is risen. Our terms of delivery and payment exclude the application of contradictory terms that have been demanded by buyers on order forms or in any other way.

2. Terms of Delivery
2.1. All deliveries are made ex works Offenbach. All our deliveries are made at costs and risk of the buyer.
2.2. Delivery dates are only with our definitive confirmation obliging. For orders with delivery dates stated by the manufacturer, our delivery terms of 3 weeks after receipt of the order are open and without obligation. Delivery problems of the manufacturer release us from the obligation to deliver in time. Claims for damages cannot be asserted to us.
2.3. We reserve the right to deliver partially. In any case we reserve the right to deliver successor models provided that they still fulfil the agreed specifications and are not more expensive than the ordered item.

3. Prices
3.1. All prices include 19% VAT and exclude postage, packing and insurance.
3.2. For price changes effectuated by the manufacturer between ordering and delivery of goods we reserve the right to a cost-covering change in our prices.
3.3. Customers from Non - EU - Countries are released from paying of the VAT.
3.4. For orders under €uro 55,00 we charge €uro 5,50 handling fee.

4. Terms of Payment
4.1. VISA, Mastercard, JCB Card. Cash on delivery and direct debit is not possible exterior of Germany !

5. Terms of Interest
5.1. If the 30th day of the date shown on the invoice is exceeded, default interest according to the usual debit interest of the banks will be charged, at least 5% over the basic interest rate of the European Central Bank.

6. Guarantee
6.1. We reserve the right to either replace or repair from us delivered merchandise if it proofed defective after consulting the manufacturers.
6.2. Complaints on obvious defects can only be made within 10 days after receiving the goods, hidden defects after their discovery, but the latest six months after receipt of the merchandise. The defect has to be risen in writing and including receipt.
6.3. For tailor-made suits we reserve the right to change it. We only take items back if the change did not work out.
6.4. There are no unbreakable blades. Even with typical sporty use we can hence not take any warranty unless the customer can prove to us and the manufacturer that it was due to a material defect.

7. Proviso clause
7.1. Until full payment is made - for payments by credit card, cheques and transfers until their credit entry - the goods remain our property.
7.2. The buyer is committed to inform us immediately of any action of third persons on the goods in our property, especially execution measures or other confiscation.
7.3. The goods and resulting exaction may not be pledged or be passed on as security or be sold until our exaction i s fully paid.

8. Final terms
8.1. Notices of defect, withdrawal or notice of the customer have to be made in writing.
8.2. If one or more regulations of the GTB or these conditions should become null and void or impracticable, it does not affect the remaining regulations. As for the rest, the legal regulations apply.

9. Place of Fulfilment
9.1. The contract relations between the parties remain exclusively under German law.
9.2. Place of Fulfilment and legal domicile for deliveries and payments - including payments by credit card or cheque - is Offenbach am Main / Germany.
